Practice the most important organizational technique in legal writing: leading with your conclusion.

Your Task

Write a point-first paragraph analyzing the enforceability question below. Your paragraph must:

Start with your conclusion — First sentence = your answer to the question
Support with reasoning — Next 2-3 sentences explain WHY, connecting facts to the rule
Anticipate the counterargument — Briefly address the strongest opposing point
Land cleanly — End with a sentence that reinforces your point

Aim for 80-120 words. The test: can a busy judge read your first sentence and know your position?

QUESTION: Is the employer's email monitoring policy enforceable against employees who were not informed of the policy at hiring?

FACTS: Meridian Corp. implemented an email monitoring policy in January 2024. The policy was posted on the company intranet but not individually communicated to employees. Sarah Torres, hired in 2022, used her work email for personal legal consultations with her attorney. Meridian discovered and read these emails during routine monitoring. Torres argues the policy violates her reasonable expectation of privacy.

RULE: Under the Electronic Communications Privacy Act, employer monitoring is permissible when: (1) the employer provides clear notice of monitoring, and (2) employees consent to monitoring as a condition of using employer systems. Courts have held that posting a policy on a company intranet, without more, does not constitute adequate notice. See Rivera v. TechCorp (2023) (notice must be "actual and conspicuous, not merely constructive").
